Event attendance agreement

Orders for tickets generally only constitute an offer to conclude an event attendance agreement. Such an agreement is only concluded upon delivery of the tickets via our website, subject to these General Terms and Conditions (hereinafter referred to as “GTC”). The visitor expressly agrees to the validity of these GTC. This also applies to free tickets, exhibitors, and invitations.

 

Cancellation/postponement of the event

If the event is canceled, the organizer will refund the full ticket price. If the event is postponed, visitors must cancel within 4 weeks of the postponement being announced. In both cases, tickets will be refunded within 60 days of the organizer receiving the returned tickets. Further claims are excluded.

Venue

The Japan Food Fest (hereinafter referred to as “event”) will take place in Halle 550 (Zürich Oerlikon). These terms and conditions apply to the entire event site and its access routes. Changes to the venue are possible and will be announced by the organizer in good time before the start of the event.

 

Right of withdrawal when purchasing tickets

There is no right of withdrawal for services related to leisure activities. Tickets can only be canceled in exceptional cases and as a gesture of goodwill. Tickets can only be refunded if the event is canceled or postponed.

 

Loss of tickets

There is no entitlement to replacement tickets if tickets are lost.

Changes to the announced program

The organizer has the right to make changes to the announced program. Visitors are not entitled to make any claims in the event of changes to the program or offer.

 

Program items and participation

There is no entitlement to compensation in the event of delays in the program schedule. In addition, individual program items may take place in rooms with applicable maximum capacities. For the safety of visitors, these may be checked by security personnel. Participation in these program items cannot be guaranteed. The organizer does not guarantee the appearance of announced guests. In the event that an announced guest cancels, the organizer will provide a replacement if possible.

Admission

Admission to the event grounds is only permitted with a valid admission ticket. This must be presented by the visitor to the supervisory staff at the entrance control. Children and young people under the age of 12 are only admitted when accompanied by a parent or guardian.

 

Proof of age

As proof of age, especially when purchasing alcoholic beverages, it is necessary to carry an officially certified photo ID (e.g., ID card, passport, or driver's license) and present it to the supervisory staff upon request.

 

Right to refuse admission

The organizer has the right to refuse admission to the event site without refunding the admission price if there is an important reason for doing so. Such a reason exists in particular, but is not limited to, the following cases:​

  • The visitor violates existing house rules or the house rules of the event.

  • The visitor carries items that are prohibited on the event grounds.

  • The visitor has consumed excessive amounts of alcohol or is clearly under the influence of drugs.

  • The visitor displays violent behavior.

  • The visitor openly displays radical/inhumane attitudes.

 

Overcrowded areas

If individual areas or halls are at risk of becoming partially overcrowded, security personnel are authorized to temporarily deny access to these areas and to direct visitor flows in a safety-oriented manner. The instructions of the security personnel must be followed.

Animals

Dogs are permitted. Dogs must be kept on a leash at all times. A short leash is mandatory to prevent accidents or dog fights. Owners are responsible for disposing of their pets' waste.

 

Bag checks

Visitors agree that bags, boxes, backpacks, or other items of transport may be searched at random when entering and leaving the event.

House rules

  • Smoking is strictly prohibited in the buildings!

  • As a general rule, visitors are not permitted to consume their own food and beverages on the premises. Only families with children under the age of 12 are permitted to bring food for their children and consume it on site.

  • Damage of any kind must be avoided, in particular damage caused by fire, water, vandalism, and theft.

  • We accept no liability for theft, loss, or damaged items.

  • Independent modifications to buildings and technology are prohibited.

  • The distribution of flyers and advertising, the sale of goods, and filming for commercial purposes are only permitted after consultation with the responsible organizers.

  • Escape and rescue routes must be kept clear. Stairs are not benches.

Liability of the organizer

The organizer and its representatives are liable for damages caused intentionally or through gross negligence. In the event of a breach of essential contractual obligations (so-called cardinal obligations) based solely on simple negligence, the organizer's liability is limited to compensation for foreseeable damage typical for this type of contract. Essential contractual obligations are all obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the visitor regularly relies and may rely. Except in the aforementioned cases, the organizer is not liable for damages caused by simple negligence. Insofar as the organizer's liability is excluded or limited in accordance with the preceding paragraphs, this also applies to the liability of its vicarious agents and assistants. The above exclusions and limitations of liability also apply to tortious claims insofar as these compete with contractual claims. The above exclusions and limitations of liability shall not apply insofar as insurance cover exists on the basis of liability insurance. Nor shall they apply to claims under the Product Liability Act insofar as liability for personal injury and property damage exists under mandatory standards of product liability law. The person responsible is fully liable for property damage and personal injury. The organizer is not liable for lost items.

Data protection

The privacy policy available on the website www.japanfoodfest.ch applies.

 

Image, sound, and image-sound recordings

Visitors are generally permitted to make image, sound, and image-sound recordings at the event. This permission does not apply to program components and/or event areas that are marked accordingly by the organizer. With regard to these program components and/or event areas, the making of any image, sound, and image-sound recordings is strictly prohibited. In the event of a violation, the organizer is entitled to expel the visitor from the event premises without refunding the admission price and to issue a ban on entering the premises. If the visitor does not comply with the expulsion and the ban on entering the premises, the organizer may call in the police to enforce its domiciliary rights. Further rights and claims of the organizer remain unaffected by this.

Choice of law, place of performance, and place of jurisdiction

All legal relationships between visitors and the organizer are subject to Swiss law. For visitors residing abroad as well as those residing in Switzerland, Baar, as the registered office of the organizer, is the place of performance and exclusive place of jurisdiction for all proceedings.
